Across all industries, including the public sector, Artificial Intelligence is rapidly transforming the landscape. This explosive growth demands clear and well-defined terms and conditions for AI use, benefiting both buyers and sellers. In April 2025, the New York State Office of Information Technology Services developed and implemented Appendix C-AI, an addendum to their existing Appendix C, the Standard Clauses for NYS ITS Contracts. This initiative prepared New York State for the AI solutions of today and the innovations of tomorrow. Mark Belkin will review key points included in Appendix C-AI, including the existing policy “Acceptable Use of Artificial Intelligence Technologies,” notice requirements, and compliance. Furthermore, Mark will explore the Agency Best Practices for AI Acquisition Memo, providing insights into the concepts and clauses that public sector agencies and buyers should consider in this new arena.
